Terms of Service

1. Acceptance of Terms

By using the ArabGym platform (the “Service”), you acknowledge that you have read and understood these terms and agree to be bound by them. If you use the Service on behalf of a company or organization, you represent that you have the authority to accept these terms on its behalf.

2. Description of the Service

ArabGym is a SaaS (software as a service) platform for managing gyms and fitness centers. The Service includes: member management, subscriptions, attendance, group classes, payments, reports, staff management, lockers, equipment, lead management, and any other features that may be added in the future.

3. Account and Registration

  • You must be at least 18 years old to register.
  • You are responsible for keeping your account credentials confidential and preventing unauthorized access.
  • You must provide accurate and correct information when registering and update it as needed.
  • Sharing a single account among multiple unrelated gyms is prohibited.
  • You are responsible for all activity that takes place through your account.

4. Subscription and Billing

  • The trial period starts with 30 free days, with no credit card details required.
  • When the trial period ends, you choose one of two plans with the same features: US$9.99 per month, or US$99.99 per year paid in a single payment (a 17% saving). Billing and collection are in US dollars in both cases.
  • You can switch between the monthly and annual plans at any time from the billing page. The new price applies to the next invoice; the amount or term of an invoice already issued and paid does not change.
  • Subscriptions renew automatically at the end of each billing cycle (a month or a year, depending on your plan) unless you cancel at least 24 hours before the renewal date.
  • Amounts paid for the current billing cycle are not automatically refunded on cancellation; you may submit a prorated refund request for unused days from the billing page, to be reviewed by our team.
  • We reserve the right to change prices with at least 30 days' prior notice.
  • Taxes may apply depending on your geographic location.

5. Acceptable Use

You may not use the Service for:

  • Any activity that violates applicable laws and regulations.
  • Publishing offensive or harmful content, or content that infringes the rights of others.
  • Attempting to breach the systems or circumvent security measures.
  • Collecting other users' data without their consent.
  • Entering false or misleading data for gym members.
  • Using the Service for commercial activities other than gym management without prior permission.

6. Member Data and Your Responsibilities

You own your gym members' data and are legally responsible for it. You must:

  • Obtain your members' consent to collect and process their data.
  • Inform them of how their data is used, in accordance with applicable data protection laws.
  • Not enter sensitive data that is not necessary to operate the gym.
  • Comply with the data protection regulations applicable in your country.

7. Intellectual Property

All intellectual property rights in the platform (code, design, logos, content) are owned by or licensed to ArabGym. This agreement grants you no right to copy, distribute or modify any part of the platform. Your gym's and your members' data remains your property.

8. Disclaimer and Warranty Limits

The Service is provided “as is” without express or implied warranties. We do not guarantee that the Service will be error-free or operate without interruption. We make every effort to maintain 99% availability of the Service, but we are not responsible for interruptions caused by force majeure or failures of third-party service providers.

9. Limitation of Liability

To the maximum extent permitted by law, ArabGym's total liability to you shall not exceed the subscription fees you paid during the three months preceding the incident. We are not liable for indirect, incidental or consequential damages.

10. Termination

  • You may cancel your subscription at any time from your account settings.
  • We may terminate or suspend your account if you violate these terms.
  • Export your reports (revenue and attendance as CSV) before you cancel. After cancellation the account is closed and we retain the data for 90 days, during which support can restore it, before it is permanently deleted.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising from them shall first be resolved through negotiation and, failing that, referred to the competent courts in the Kingdom of Saudi Arabia.

12. Changes to the Terms

We reserve the right to amend these terms at any time. We will notify you of any material changes by email 30 days in advance. Your continued use of the Service after notice of an amendment constitutes acceptance of the updated terms.
